The terms and conditions outlined below refer to the competition that can be found here, or otherwise referred to as the “2015 Art Prize Competition”. You are advised that the terms & conditions stated below are in addition to State and Commonwealth Legislation, this legislation provides you with protections not stated below, these protections cannot be overridden by us. However, in instances where a conflict exists, the conflicting term(s) will be severed from these terms and conditions, and wherever legal to do so the gallery will continue to enforce the remainder of the terms and conditions stated below.
Entrants to this competition are entering into a competition with the opportunity to win an art piece by Katherine Perrott valued at the time of the competition’s commencement at $1200.00 AUD. This art piece can be viewed prior to entering the competition. Should the first winner not be reasonably contactable then the winning entry will default to the second entry drawn, and so on until a winner is drawn and contacted successfully. Peta Barwick’s Contemporary Art Gallery may determine with its absolute discretion what constitutes “reasonably contactable” for the purposes of this condition.
The winning entrant will be invited to nominate a delivery location of the art piece within any Australian state or mainland territory. Transport costs are capped at $150.00, as a result the winner of the competition will incur any additional costs in receiving the art piece.
Peta Barwick’s Contemporary Art Gallery reserves the right to remove any entry that is deemed not in the spirit of a fair draw or competition. Entries are limited to one per person through the primary entry form. Entrants can only gain further (secondary) entries by referring others to enter. Peta Barwick’s Contemporary Art Gallery may determine with its absolute discretion what constitutes “the spirit of a fair draw or competition” for the purposes of this condition. The Gallery reserves the right to suspend the competition where the competition’s integrity may be reasonably believed to be compromised by manipulation, exploitation, reverse engineering or any other means that seek to undermine the intended competition entry process. Where a competition suspension occurs, the Gallery reserves the right to remove one or more competition entries it believes to be invalid up to and including all entries.
The holder of a drawn entry will be required to provide sufficient personal identification corresponding with the information on competition entry prior to the prize being awarded. Peta Barwick’s Contemporary Art Gallery may determine with its absolute discretion what constitutes “sufficient personal identification” for the purposes of this condition.
Peta Barwick’s Contemporary Art Gallery takes no responsibility for any entry not received by Peta Barwick’s Contemporary Art Gallery as a result of misdirection, ISP failure or otherwise.
The draw will occur on the following date and time:
-21st October 2015 12pm AEST
Entries to the competition will close all 11am AEST, 60 minutes prior to the draw time. No late entries will be accepted under any circumstances.
The winning entrant must have publicly liked the Peta Barwick’s Contemporary Art Gallery’s Facebook page and have also publicly shared the competition post on their personal Facebook page prior to the close of competition (half an hour prior to each draw being made). Should the winning entrant not have met the requirements regarding sharing and liking publicly on Facebook their entry will not be eligible to win the prize. For the purposes of this competition the term ‘Publicly’ means visible online to all members of the public and not limited to friends or acquaintances only. Peta Barwick’s Contemporary Art Gallery will perform Facebook searches and take screen shots prior to announcing the winner.
Peta Barwick’s Contemporary Art Gallery accepts no responsibility for any loss suffered by an entrant as a result of entry in this competition wherever legal to do so.
Peta Barwick’s Contemporary Art Gallery reserve the right to significantly alter or amend terms and conditions and other information relating to the competition at any time and or cancel the competition without notice at any point. However, where practical to do so the gallery will communicate these changes to participants via their nominated email address.
By entering into this competition, your email address and associated name will be stored and used to communicate marketing messages to you. In compliance with the Commonwealth Spam Act 2003, the option to opt out of these communications will be provided at the bottom of every communication. However, you are advised that providing inaccurate information at the time of entry is an automatic disqualification from participating in the competition. Every reasonable action will be taken to protect your information and it will not be sold, or distributed to a 3rd party for their own benefit. Peta Barwick’s Contemporary Art Gallery remains committed to complying by
the National Privacy Principles in the Privacy Act 1988 (Cth).
This competition is restricted to Tasmanian residents and is operated from the state of Tasmania.
You are directed to seek clarification on any aspect of these terms that you do not understand prior to entering the competition. As entering the competition will be deemed to be acceptance of these terms and conditions.
